Terms of Use

Welcome to our Services. These Terms of Use ("Terms") govern your access to and use of the products and content provided by The Common Ist Sdn Bhd (Malaysia), The Common Ist Bangkok Co.,Ltd (Thailand), and co-developed or supported by Superjaai Studio, including but not limited to our creative productions, media, mobile games, applications, websites, marketplace services, and other digital content and services (collectively, "Services"). By downloading, accessing, or using any part of our Services, you agree to be bound by these Terms. If you do not agree with these Terms, please refrain from using the Services.
1. Eligibility
You must be at least 13 years old (or the minimum legal age in your country) to use our Services. By using the Services, you affirm that you are of legal age in your country of residence. If you are not, your parent or legal guardian must review and agree to these Terms on your behalf.
2. License to Use the Services
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial use only. All rights not expressly granted to you are reserved by us.
You may not:
- Copy, modify, distribute, sell, lease, or reverse engineer any part of the Services;
- Interfere with or disrupt the operation of the Services;
- Use the Services for any unlawful purpose.
3. Intellectual Property
All content, trademarks, graphics, and code in the Services are owned by or licensed to us and are protected by copyright, trademark, and other laws. You may not use our intellectual property without our prior written consent.
4. In-App Purchases, Marketplace Transactions, and Ads
Some of our apps may offer optional in-app purchases, such as consumable in-game currency packs, or display advertisements. All in-app purchases and marketplace transactions are processed securely through third-party platforms (e.g., Apple App Store, Google Play), and we do not collect or store any payment information.
Certain in-game items—both consumable and non-consumable—are only obtainable using in-game currency earned through gameplay or acquired via in-app purchases. These items are not purchased directly with real money.
All purchases are final and non-refundable, except where required by law or as outlined in our Refund Policy. Restoration of previously purchased non-consumable items may be supported by the respective platform, typically when using the same Apple ID or Google account associated with the original transaction.
For the VIP marketplace platform (Virtual International Plants), all live plants listings, descriptions, and transactions must comply with applicable laws and our marketplace policies. We reserve the right to remove listings or suspend accounts that violate these Terms or marketplace conduct standards. We may retain limited, non-sensitive transaction information to support order management, dispute resolution, and regulatory compliance.
Our apps may also display non-personalized ads through third-party services such as Google AdMob. For more details, please refer to our Privacy Policy.
5. Refund Policy
Our refund policy applies to in-app purchases and VIP marketplace transactions as follows:
In-App Purchases:
Refunds for in-app purchases are governed by the respective app store (Apple App Store or Google Play). Requests must typically be submitted within their refund window (usually 48 hours to 30 days depending on the platform). We do not directly process refunds for in-app purchases; please contact the app store directly for refund requests.
VIP Marketplace Transactions (Live Plants):
Buyers may request cancellation before sellers deliver plants to our verification center. Upon arrival, plants undergo quality control, health assessment, and plant health documentation processing (eg. phytosanitary certificates, nematodes lab test, relevant permits, compliance records). Verified and documented plants are processed for platform shipment to buyers. Any plants failing verification automatically receive refunds, ensuring buyer protection and marketplace integrity.
Orders are typically processed for verification within 7–10 days, and shipping transit times vary by destination.
Cancellation & Service Fees:
- Pre-Shipment: Buyers may cancel for a full refund before the seller ships the item to the VIP verification center.
- In-Process: Once the plant arrives at our center and the health documentation process (e.g., lab tests, permits) has commenced, a non-refundable processing fee will apply to any cancellation. This fee covers professional assessments and government filings already incurred.
- Return Shipping: If a buyer cancels while the plant is at our center, the buyer is responsible for the cost of shipping the plant back to the seller to ensure the plant's safety.
Condition Expectations: Live plants naturally vary due to shipping stress, environment changes, and handling. Buyers acknowledge this inherent variability—this is not equivalent to purchasing manufactured goods. Plants may experience minor leaf damage, stress marks, or color variations during transit.
Claim Requirements: Buyer must report issues within 24 hours of physically receiving the package with high-quality photos and video documentation (if applicable).
Eligible for Refund:
- Wrong item shipped
- Dead on arrival (DOA)
- Severe damage (beyond normal transit stress)
- Major misrepresentation vs. listing
Not Eligible for Refund:
- Minor leaf damage or cosmetic imperfections
- Buyer regret or delayed claims (beyond 24 hours)
- Transit or weather-related damage (buyer assumes risk upon shipment)
- Courier delays or buyer-provided wrong address
- Plant stress from post-arrival care
No Returns Accepted: Returns are declined due to plant damage risk and import/export complications.
International Orders: Buyer is responsible for import regulations, customs permits, and compliance. Platform is not liable for confiscation, customs issues, or regulatory holds.
Processing: Refund requests are reviewed and processed by our platform. Approved refunds will be processed within 5–10 business days to the original payment method. Our decision is final and binding.
6. User Conduct and Use Limitations
You agree not to:
- Use the Services in any way that violates applicable laws or regulations;
- Harass, abuse, or harm others, or promote or incite violence or discrimination;
- Post or share any content that is obscene, sexually explicit, defamatory, hateful, or otherwise offensive or inappropriate;
- Use, distribute, or develop cheats, automation software, bots, hacks, mods, or unauthorized third-party software that interferes with the operation of the Services;
- Modify or alter any part of the Services without our express written consent;
- Disrupt or interfere with the normal flow or operation of the Services or other users' experience;
- Attempt to gain unauthorized access to any systems, accounts, data, or networks connected to the Services;
- Upload or share content that infringes on the intellectual property or privacy rights of others;
- Reverse engineer, decompile, or otherwise attempt to extract the source code of the Services;
- Collect or solicit personal information from other users without consent;
- For marketplace participants: engage in fraudulent listings, misrepresentation, or any conduct that violates marketplace policies.
7. Account and Data Deletion
If you use our Services with a platform sign-in (e.g., Game Center, Google Play Games), you may delete your game account and associated data from within the app. For marketplace accounts, you may delete your account and associated data. This action is permanent and cannot be undone. It will remove your profile, progress, purchases, and saved data tied to the platform account. For more details, please refer to our Privacy Policy.
Please note that deleting your account does not automatically remove your marketplace ratings or reviews. To request removal of such content, please contact us.
8. Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Services will be uninterrupted or error-free.
9. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits or data, arising out of your use or inability to use the Services.
10. Termination
We may terminate or suspend your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the Services. This includes but is not limited to fraudulent activity, repeated policy violations, or harassment of other users.
11. Changes to the Terms
We may update these Terms from time to time. If we make material changes, we will notify you via the Services or other means. Continued use of the Services after changes are made indicates your acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of Malaysia, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Malaysia. For marketplace transactions involving users in Thailand, local Thai consumer protection laws apply where they provide additional protection to consumers.
